Privacy Statement

This Privacy Statement describes our collection, storage, processing, sharing and other activities with respect to your information. When you (or your agent) give us your personal information, and/or when you use a website, online resource, or other good or service that we provide that posts, or is associated with, this Privacy Statement, you consent to our treatment of your personal information as described in this Privacy Statement.

When this Privacy Statement refers to “MWCPF,” “CAOM,” “we,” “us,” or similar terms, we mean the Michigan Worker's Compensation Placement Facility, a facility authorized and organized by Chapter 23 of the Michigan Insurance Code of 1953 (MCL §§ 500.2301 to 500.2352) and the Compensation Advisory Organization of Michigan, a Michigan nonprofit corporation.

When this Privacy Statement refers to “you” or uses similar words, it means the subject of the personal information discussed in this Privacy Statement.

Other privacy statements may also apply to specific CAOM/MWCPF resources that you use.  Those privacy statements should be read together with this one and, where the other privacy statement is more specific to the goods, services or software associated with that privacy statement, that privacy statement will apply.

Other third-party services or applications that are used in connection with CAOM/MWCPF’s services might also have their own privacy statements.  Those statements have separate terms and should be read independently from this Privacy Statement.

What information does CAOM/MWCPF collect?

CAOM/MWCPF collects personal information like name, address, telephone number, other contact information, billing and payment information, information about business roles, preferences for services, demographic information, requirements of your organization for insurance, information required for rating risk and placing insurance, and information about your, or your company’s interactions with CAOM/MWCPF.

CAOM/MWCPF, or its Internet service provider, may collect log-file information, such as Internet protocol (IP) addresses, browser type, Internet service provider (“ISP”), referring/exit pages, platform type, date/time stamp, and number of clicks, and other information useful for providing and improving such services.

If you provide personal information of a third party to CAOM/MWCPF (such as when you set up an employee or agent to enable that person to receive services or to deal with us on your behalf, or where you provide information necessary or helpful in order to rate, underwrite, or place insurance), you represent and warrant to CAOM/MWCPF that you have all necessary authority to provide that information to CAOM/MWCPF and to grant to CAOM/MWCPF all rights in the information necessary for CAOM/MWCPF to do everything with that information that this Privacy Statement permits CAOM/MWCPF to do.

CAOM/MWCPF collects information about its present, past, and potential participants in insurance and related markets so that CAOM/MWCPF can provide required notices, permit participation markets, or otherwise communicate and do business with such persons.

How does CAOM/MWCPF collect personal information?

CAOM/MWCPF collects some of the information directly from you when you provide it to CAOM/MWCPF, whether through CAOM/MWCPF’s website(s), by doing business with CAOM/MWCPF or when you acquire services from CAOM/MWCPF or its affiliates or other market participants. CAOM/MWCPF collects information from other sources, as well, such as directories, people who acquire CAOM/MWCPF services for you or for your benefit, and third-party information providers.

How does CAOM/MWCPF use the information that it collects?

CAOM/MWCPF uses personal information in the following ways.

To provide goods and services, directly or indirectly, to you and/or to your organization(s);

To analyze business and related activities and to administer websites, apps, and other resources;

To communicate with you; and

To provide offers by CAOM/MWCPF or third parties that might interest you.

If CAOM/MWCPF anonymizes the information (combines it with other information, redacts it, or otherwise makes it so that it no longer reasonably identifies you), CAOM/MWCPF can use the information for any purpose.

How does CAOM/MWCPF treat information of persons under the age of 18?

It is CAOM/MWCPF’s policy to refrain from knowingly collecting or maintaining personally identifiable information relating to any person under the age of 18. If you are under the age of 18, please do not supply any personal information to CAOM/MWCPF. If you are under the age of 18 and have already provided personal information to CAOM/MWCPF, please have your parent or guardian contact CAOM/MWCPF immediately using the information below so that CAOM/MWCPF can remove such information from its files. If you are the parent or guardian of a person under the age of 18 and you have reason to believe that that person’s personal information has been collected by CAOM/MWCPF, please contact CAOM/MWCPF immediately.

How does CAOM/MWCPF use online tracking methods?

CAOM/MWCPF uses cookies and other methods on its website(s) and/or other resources to provide offers that might interest you and to personalize the content that CAOM/MWCPF provides to you on CAOM/MWCPF’s website(s) and/or other resources. CAOM/MWCPF may also serve, provide, or designate the content of, ads or other presentations on third-party websites. including on third-party websites or as part of third-party services. Some cookies or similar devices exist only during a particular session and some are persistent over multiple sessions over time.

These methods can allow you to maintain your account log-in information and other information between visits and they allow CAOM/MWCPF to measure and record activity.

CAOM/MWCPF may use advertising service providers to serve CAOM/MWCPF advertisements on other websites or resources that you visit or use. In serving CAOM/MWCPF advertisements, these companies may use cookies and other tracking devices to collect information about your visits to other websites and resources, like browser type, IP address, which page or content was visited, and time of day. CAOM/MWCPF uses this information to evaluate advertising, customize user experience, and focus marketing and other communications to you and users like you.

Third parties whose websites or other resources you use might also use cookies or other tracking methods. This Privacy Statement does not apply to third parties’ practices. You should obtain and read the privacy statements of those third parties to understand their practices with respect to cookies and other tracking devices.

You can set your web browser to reject cookies. Each browser is different, so you should check your browser’s “Help” menu to learn how to change your cookie preferences.  If you reject or block cookies, CAOM/MWCPF’s website(s) might not function as intended. 

Many web browsers have a “do not track” setting. That said, there is no widely-accepted standard (through the World Wide Web Consortium or otherwise) governing what should happen when a user selects “do not track” in his or her browser. If and when an industry consensus is reached about how to treat a “do not track” setting, CAOM/MWCPF will determine whether to follow that consensus approach.  In the meantime, enabling “do not track” in your browser will not change what information is exchanged with your computer, or how that information is use.

With whom, and how, does CAOM/MWCPF share your information?

  1. Anonymized information.  If CAOM/MWCPF anonymizes information (i.e., combine it with other information, redacts it, or otherwise makes it so that it no longer reasonably identifies you), CAOM/MWCPF may share that information with anyone for any purpose.
  2. Outsourcing providers. CAOM/MWCPF may provide your information to outsourcing providers to process and ship orders, host and/or run our information technology systems, provide technical support, provide training, or perform other functions in support of CAOM/MWCPF’s conduct of its business.
  3. Participants in the insurance market. CAOM/MWCPF may provide information to, and among, customers for insurance, providers of insurance, and similar parties as a part of its placement operations and as otherwise contemplated by the law that authorizes and governs CAOM/MWCPF’s operations.
  4. Successors.  If CAOM/MWCPF transfers (or investigates the potential transfer of) all or a part of its operations (whether through government-mandated restructuring or reassignment or otherwise), CAOM/MWCPF may transfer to, or share with, the actual or potential transferee, the personal information associated with the potentially or actually transferred operations. Such transfer would be for the purpose of facilitating due diligence and/or allowing the transferee to carry on the relevant operations.
  5. To comply with legal requirements. CAOM/MWCPF may share your information if required by law enforcement, government agencies, courts, or others where CAOM/MWCPF believes that its cooperation with information requests is required by law.

What about links and other information provided by others?

One or more of CAOM/MWCPF websites or other resources might contain links to other websites or other resources that are not operated by CAOM/MWCPF. CAOM/MWCPF does not operate those websites or resources and CAOM/MWCPF cannot control the information that the operators of such websites gather or what the operators of such websites do with the information. CAOM/MWCPF is not responsible for the activities of the operators of such other websites or resources.

How does CAOM/MWCPF secure and safeguard my information?

CAOM/MWCPF uses, and requires that its service providers use, commercially reasonable physical, technical, and other safeguards designed to prevent unauthorized access to, use of, or alternation of, your information.

Does CAOM/MWCPF supplement the information that I provide?

CAOM/MWCPF sometimes supplements the information that it receives from you with other information that CAOM/MWCPF receives from third-party sources, such as directories and information clearinghouses.

How May CAOM/MWCPF notify me in the case of a data breach?

For the purposes of any applicable law regarding notification of persons whose personal information was, or is reasonably believed to have been, acquired by an unauthorized person, CAOM/MWCPF’s information security policy provides that any required notification may, where permitted by law, be made by the use of e-mail, telephone, fax, mail (including, but not limited to, a notice printed in an available area of a bill or statement) or posting a notice on CAOM/MWCPF website or other electronic resource. The specific means used is up to CAOM/MWCPF and CAOM/MWCPF will use its commercially reasonable judgment based on the circumstances. Where any notice is to be sent to a specific address or number (such as e-mail address, physical address, telephone number, etc.), CAOM/MWCPF will use the latest available address in its records. EXCEPT TO THE EXTENT PROHIBITED BY LAW, YOU AGREE TO THIS MEANS OF NOTIFICATION.

How can you correct your personal information?

If your personal information changes, if you have reason to believe that your personal information as CAOM/MWCPF maintains it is incorrect, or if you no longer desire service, you may contact CAOM/MWCPF using the contact information below and CAOM/MWCPF will accommodate all reasonable requests for such changes.

How does CAOM/MWCPF handle choice and opt-out?

Users who no longer wish to receive communications or promotional materials or have their information provided to third parties may opt to not receive such communications or have information shared by contacting CAOM/MWCPF using the information below. Please be prepared to tell us the specific CAOM/MWCPF good or service with respect to which you wish to opt out. CAOM/MWCPF will comply with such requests as soon as is commercially practicable. Such compliance may involve batch processing and other processes that take 30 days or longer. If you opt not to receive such communications or allow CAOM/MWCPF to share your information and then give your personal information to CAOM/MWCPF again using a site or under other circumstances that permit us to use your information, CAOM/MWCPF will regard your opt-out as rescinded.

Note that opting out will not have any effect on information that CAOM/MWCPF has shared with third parties as permitted by this Privacy Statement.

Where you or your organization have ongoing business with CAOM/MWCPF or there are other legitimate reasons for CAOM/MWCPF to keep and use your information (including, but not limited to, contracts that have not been fully performed, litigation, dispute resolution, requirements by law enforcement or other units of government, or other matters), CAOM/MWCPF reserves the right to retain your information for use in connection with such matters.

What if I opt out and then do things that opt me back in?

If, after opting out, you do certain things that invite us to use your personal information again, CAOM/MWCPF will regard you as having opted back in. Examples include, but aren’t limited to, asking one of CAOM/MWCPF’s personnel (verbally or otherwise) to send you information, asking CAOM/MWCPF to provide services to you or your organization, or similar communications or transactions. As always, CAOM/MWCPF will abide by the provisions of this privacy statement with respect to your personal information that you provide to CAOM/MWCPF.

How quickly does CAOM/MWCPF respond to requests?

CAOM/MWCPF will use commercially reasonable efforts to timely make any changes you request. Many such changes are accomplished using batch processing (i.e. collecting a number of similar change requests and making all such changes at once), so the changes might not be immediately effective. If you require an immediate change to your personally identifiable information and are unable to make such a change using the available site resources, please contact us using the information below.

How does CAOM/MWCPF handle changes to this Privacy Statement?

If CAOM/MWCPF decides to change this Privacy Statement, CAOM/MWCPF will post the changes on one or more websites and/or other places that CAOM/MWCPF reasonably believes will give you notice of the change if you’re paying reasonable attention to the privacy provisions of CAOM/MWCPF’s website(s) and/or resources. If you fail to object within a reasonable time, not to exceed 30 days, to any change in this Privacy Statement so posted, the revised Privacy Statement will apply to you and your personal information.

If CAOM/MWCPF is required by law to notify you of, and/or obtain your consent to such a change, CAOM/MWCPF may notify you and/or seek your consent by any commercially reasonable means. If you reply to CAOM/MWCPF’s notice or request within a reasonable time and request that CAOM/MWCPF not use your personally identifiable information in the proposed new manner, CAOM/MWCPF will honor your request, but CAOM/MWCPF reserves the right to suspend your access to all or part of the services offered through one or more sites if you do so.

Are there exceptions to the other provisions of this Privacy Statement?

Notwithstanding anything else in this privacy statement to the contrary, CAOM/MWCPF may collect personal information and use such information in ways other than those described above if CAOM/MWCPF is required to do so by law or if CAOM/MWCPF deems it advisable in the course of assisting law enforcement activities or protecting CAOM/MWCPF’s websites, other online services, resources, property, or rights. Without limiting the foregoing, CAOM/MWCPF reserves the right to use and disclose any information that you provide to CAOM/MWCPF if CAOM/MWCPF deems it advisable in the prosecution or defense of any litigation or other claim involving your use of good or service of CAOM/MWCPF.

Your California Privacy Rights

If you are a California resident, California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by certain CAOM/MWCPF Enterprise Companies to third parties for the third parties’ direct marketing purposes.
